I am looking to set up a new charity shop.  One of the things I'd like to do is encourage local designers to sell their clothes in the shop with 50% of the profits going to them and 50% to the charity.  Is this allowed or will it affect the shop's VAT benefits? Does anybody know where I can go to for this information?

The Association of Charity Shops are probably the best place to get advice on this (and any other questions that arise as you go forward).

There are both VAT and rates relief implications for charity shops of entering into 50:50 partnerships, and you should seek separate expert and legal advice.

One of the tests for charity shops to gain 80% mandatory rates relief is that they sell "wholly or mainly" donated goods. Goods sold in 50:50 arrangements are not likely to be treated as donated goods, and this may have an impact on your eligibility for rates relief.

Equally, the zero rating for VAT that charity shops enjoy is on sales of donated, second hand goods. This zero rating is not likely to apply to 50:50 goods.

I suggest you visit the HMRC website for more on VAT, rates and tax in general.
